Effective date: January 1, 2025
Please read these Terms of Service carefully before using the Invictus Bids platform.
By accessing or using the Invictus Bids platform (website, mobile application, or any related services), you agree to be bound by these Terms of Service. If you do not agree, you may not use the platform.
You must be at least 18 years of age to register or participate in any auction. By creating an account, you represent and warrant that you meet this requirement and that all information you provide is accurate and complete.
Each user may hold one account. You are responsible for maintaining the confidentiality of your PIN and for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access. We reserve the right to suspend or terminate accounts that violate these terms.
All bids placed on Invictus Bids are final and legally binding. Once a bid is submitted, it cannot be retracted. By placing a bid you are committing to pay the full hammer price plus any applicable buyer's levy if you are the winning bidder. Bidding on items you do not intend to purchase is strictly prohibited.
A buyer's levy (commission) is added to the hammer price on all winning bids. The applicable rate is displayed on each auction listing before you bid. The total payable amount is the hammer price plus the buyer's levy.
Payment is made directly to the auctioneer upon collection of your won item. Failure to pay within five (5) days of the auction ending will result in your account being flagged. Flagged accounts are required to pay a deposit before participating in future auctions. Repeated non-payment may result in permanent suspension.
Invictus Bids may require bidders to maintain a minimum wallet balance to participate in high-value auctions. Your wallet balance acts as a security deposit that grants leverage to bid up to ten times its value on qualifying items. Wallet top-ups and deposit requirements are managed within the app.
Auctioneers are responsible for accurately describing all items listed on the platform, providing clear photographs, and honouring completed sales. Auctioneers must be approved by Invictus Bids before listing items. Misrepresentation of items may result in account suspension and liability for damages.
Users may not: (a) shill bid or manipulate auction outcomes; (b) use automated tools or bots to place bids; (c) harass or defraud other users; (d) circumvent any platform security measures; (e) list counterfeit, stolen, or prohibited items. Violation of these rules will result in immediate account termination and may be reported to law enforcement.
All content, design, logos, and software on the Invictus Bids platform are the intellectual property of Invictus Bids or its licensors. You may not reproduce, distribute, or create derivative works without prior written consent.
Invictus Bids provides the platform as a venue connecting buyers and sellers. We are not a party to the transaction between buyers and auctioneers. To the fullest extent permitted by applicable law, Invictus Bids shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of the platform.
We collect and process personal data as necessary to operate the platform. We do not sell your personal information to third parties. By using Invictus Bids you consent to the collection and use of your data as described in our Privacy Policy.
We may update these Terms of Service at any time. Material changes will be communicated via the app broadcast system or email where available. Continued use of the platform after changes are posted constitutes acceptance of the revised terms.
These Terms are governed by the laws of the Republic of Zambia. Any disputes arising from these Terms or your use of the platform shall be subject to the exclusive jurisdiction of the courts of Zambia.
